Subject: Best Change of Position articles

Dear Colleagues,

As some of you know, I'm attempting to construct a coherent, useful, explanation for contribution between wrongdoers placing the right in equity, not unjust enrichment as (common law) UE is currently defined. My current premise is that contribution can't be coherently squeezed into UE as it's currently explained in the UK or Canada without creating unprincipled exceptions in either UE or contribution doctrine. For various reasons, that makes change of position arguments very important.

If any of you have views on the 3 best articles on the change of position defence - common law or civilian, English or other languages, that you'd care to share, I'd be much obliged.

On list or off, as you prefer.

Best regards,

David Cheifetz
